The controversial state Senate Bill 1070 was signed into law by Arizona Governor Jan Brewer on April 23, 2010 and will officially go into effect on July 28, 2010. The law is the strictest state law put forward that attempts further crackdowns on illegal immigration in addition to current federal laws. Critics of the law claim it encourages racial profiling, especially to those who are of Hispanic heritage.
Provisions of Senate Bill 1070
The law makes it a state misdemeanor for anyone to be in the United States unlawfully and requires police to make an attempt to determine a person's immigration status if there is reasonable suspicion. This is not the same as probable cause as it is left to the individual officer to make such a determination and there are no set guidelines.
Regarding probable cause, police may, without a warrant, arrest a person if the person is an illegal alien or is a legal alien not in possession of registration documents that the person is required to carry by federal law. A person arrested cannot be released without confirmation of the person's legal immigration status by the federal government.
